General Terms and Conditions of Sale
Article 1. Purpose
These general terms and conditions of sale (hereinafter referred to as the "GTC") govern all relations between SELKEYS FRANCE and any person wishing to make an online purchase of one or more product(s) offered for sale by SELKEYS FRANCE on the website selkeys.fr (hereinafter referred to as the "Website"). It is specified that these GTC apply exclusively, excluding any other conditions, particularly those in effect for sales made in stores, boutiques, pharmacies, and/or drugstores offering SELKEYS FRANCE products.
Article 2. Scope of Application
The GTC exclusively govern online sales contracts of SELKEYS FRANCE products (hereinafter the "professional seller") to buyers who qualify as consumers (hereinafter the "Consumer"). Together with the online order, they constitute the binding contractual documents between the parties, to the exclusion of any other documents, brochures, catalogs, or product photographs, which are provided for information only.
For the purposes of these GTC, the term "Product(s)" refers to the product(s) offered for sale on the Website and shipped by the professional seller.
The Consumer is any non-commercial natural person acting for purposes outside their trade, business, craft, or profession who visits one or more web pages of the Website, whether or not they initiate a purchasing process. The Consumer must have full legal capacity and be of legal age.
The GTC apply exclusively to products delivered to consumers residing in France and/or in a member state of the European Union. The GTC and all contractual information provided on the Website are written in French.
Article 3. Availability and Enforceability of the GTC
SELKEYS FRANCE reserves the right to modify the GTC at any time by publishing a new version on its Website. The applicable GTC are those in force at the time of payment (or the first payment in the case of multiple payments) of the order.
The GTC are made directly available to consumers on the seller's Website. They are enforceable against the consumer, who acknowledges, by checking a box provided for this purpose, having read and accepted them before placing an order.
By accepting the GTC, the Consumer acknowledges receiving the necessary advice and information to ensure the suitability of the offer for their needs. The Consumer declares being legally capable of entering into a contract under French law or being duly represented by the individual or legal entity on whose behalf they act. Unless proven otherwise, the information recorded by the professional seller constitutes proof of all transactions. Validation of the order by the Consumer's confirmation constitutes their adherence to the GTC in effect on the order date, which are preserved and reproducible by the professional seller in accordance with Article 1127-2 of the French Civil Code (formerly Article 1369-4).
The invalidity of a contractual clause does not entail the nullity of the GTC. The temporary or permanent non-application of one or more clauses by the professional seller does not constitute a waiver of the other clauses of the GTC, which continue to have effect.
This contract and the GTC governing it are subject to French law.
Article 4. Products and Availability
The offers for Products made by SELKEYS FRANCE on the Website remain valid as long as the Products are available on the Website and within the limits of available stock.
Products temporarily out of stock are marked as such on the Website (indicated as “Unavailable”), and the Consumer may provide their email address to be notified when the Product is back in stock. However, despite the professional seller's efforts to manage inventory accurately, errors may exceptionally occur regarding stock levels. In such cases, the professional seller will notify the Consumer by email of the unavailability of the Product(s) concerned as soon as possible. SELKEYS FRANCE will then take steps to refund the price of the unavailable Product(s). The bank account associated with the credit card used for the order will be re-credited with the overpaid amount within thirty (30) days from the notification sent to the Consumer.
Aside from reimbursing the price of the unavailable Product, the seller is not liable for any cancellation indemnity unless the breach of contract is personally attributable to them. The seller may also offer a store credit equivalent to the order amount for future purchases, subject to the buyer's agreement.
Each Product offered for sale and listed in the Website’s catalog is accompanied by a description of its essential characteristics in accordance with Article L.111-1 of the French Consumer Code. Product photographs are not contractual documents.
The professional seller provides consumers with the necessary information for the proper use of the Products. SELKEYS FRANCE shall not be held liable for damages caused by misuse or non-compliance with the usage precautions of the Products sold on its Website.
The Website offers products designed for skin care (cosmetics) for sale. These Products are intended for private individuals only. Consumers are solely responsible for any use of the Products purchased on the Website. Products are for personal use only and not directly related to the buyer’s professional activity. Products sold on the Website may not be resold or repackaged without the prior written consent of SELKEYS FRANCE.
Products comply with the current legal and regulatory safety requirements for consumer protection at the time of market placement. Products also comply with the European Regulation (EC) No 1223/2009 on cosmetics.
Article 5. Prices
In compliance with Article L.112-1 of the French Consumer Code, the sales prices for each Product listed in the electronic catalog are indicated in euros, inclusive of all taxes, excluding delivery and shipping fees, which are specified before order validation and billed as an additional charge.
Additional shipping, delivery, or postage fees (including other potential fees incurred by the professional seller) are detailed in the order summary.
The total amount payable by the Consumer is shown on the order confirmation page.
The sale price of a Product is the price in effect on the order date. The professional seller reserves the right to modify prices at any time, ensuring that the Consumer is charged the price applicable on the order date.
In the event of promotional pricing, the professional seller undertakes to apply the promotional price to any orders placed during the promotion's advertised period.
The total price of each order, including delivery charges, must be paid in full at the time of ordering. Otherwise, no delivery will occur, and the sale will be considered canceled at the Consumer’s initiative.
Article 6. Offer and Contract Formation
Online sales offers presented on the Website are reserved for Consumers residing in France or a European Union member state, with delivery limited to these areas. Unless otherwise specified, online sales offers are valid as long as the Products appear in the electronic catalog and stock is available.
The Consumer accepts the offer by validating their order, in compliance with the double-click process. The double-click entails:
- Initial validation of the order.
- Confirmation of the order, which finalizes acceptance of the offer.
Promotional offers are valid only for the specified duration indicated on the Website.
The sales contract is formed upon the Consumer's confirmation of their order. Communications, order forms, and invoices are archived on reliable and durable media to create a faithful and durable copy in accordance with Article 1360 of the French Civil Code (formerly Article 1348). These documents may be used as evidence of the contract.
Article 7. Orders
To place an order, the Consumer may first register on the Website by creating an account. Upon registration, the Consumer’s email address serves as their login ID, and they select their password. Consumers are encouraged to regularly update their passwords on the “My Account” page and choose secure combinations. SELKEYS FRANCE is not liable for the consequences of weak password choices.
Consumers can also place an order as a guest by providing their email address and billing and shipping information.
To finalize the order, the Consumer adds Products to their virtual cart, reviews their selections and prices, provides delivery and payment details, and confirms the order. An email acknowledging receipt of the order and payment will be sent promptly.
Order changes requested after confirmation are subject to the professional seller’s approval.
The professional seller reserves the right to refuse or cancel orders deemed fraudulent or abnormal, especially those involving unusually large quantities not typical of consumer needs.
Article 8. Payment
All purchases on the Website must be paid in euros (€).
Accepted payment methods include credit cards (Carte Bleue, Visa, Mastercard) and PayPal accounts. Checks are not accepted. Payment details are encrypted via the “3D Secure” system to maximize data protection, and SELKEYS FRANCE does not store card information. Payments are processed immediately, and order confirmations are sent via email.
Article 9. Returns and Right of Withdrawal
In accordance with Article L.221-18 of the French Consumer Code, the Consumer has a period of fourteen (14) calendar days from the receipt of the Product(s) to exercise their right of withdrawal without providing a reason or incurring penalties. If this period ends on a Saturday, Sunday, or public holiday, it is extended to the next business day.
This right of withdrawal allows the Consumer to return any unsuitable item and request an exchange or refund (via re-crediting of the Consumer's credit card, PayPal account, or bank transfer, depending on the payment method used), excluding return shipping costs, which remain the Consumer's responsibility.
The right of withdrawal can be exercised by contacting SELKEYS FRANCE’s Customer Service via the "Contact Us" section on the Website or by email at contact@selkeys.fr.
To exercise this right, the Consumer must notify SELKEYS FRANCE of their decision to withdraw using a clear and unambiguous declaration, specifying their identity, shipping and billing addresses (if different), order number, and the date of order receipt.
The professional seller will promptly acknowledge receipt of the withdrawal request by email and provide a return authorization form.
Returns must be made in their original and complete condition, enabling resale in new condition. Any product that is opened, damaged, or altered by the Consumer will not be accepted for return, in accordance with Article L.221-28 (5) of the French Consumer Code. Products unsealed after delivery that cannot be returned due to hygiene or health protection reasons are also excluded from the right of withdrawal.
Refunds may be delayed until the returned Product(s) have been received and verified by SELKEYS FRANCE.
The Consumer is responsible for the accuracy of their billing and shipping information. According to Article L.221-23 of the French Consumer Code, the Consumer must return the Product(s) within fourteen (14) days of notifying the seller of their decision to withdraw. Products must be returned in their original packaging to the address provided on the return form.
Article 10. Contact
In case of disputes, the Consumer should first contact the company’s Customer Service via email at contact@selkeys.fr to attempt to resolve the matter informally.
For any questions regarding additional information about products, safety information, updates on new arrivals or promotions, or account termination, please contact SELKEYS FRANCE’s Customer Service at the same address.
Article 11. Delivery
Delivery refers to the transfer of physical possession of the goods to the Consumer.
Orders are processed promptly on business days (Monday to Friday, excluding public holidays).
Products are typically shipped via standard postal services such as "Colissimo 48h" and will be delivered within three (3) business days following order confirmation, subject to normal activity levels. During peak periods, delivery times may be extended.
The indicated delivery times are average estimates based on regular activity. In cases where multiple Products in an order have different availability times, delivery will be based on the longest estimated time. Partial deliveries may occur at the seller’s discretion without additional delivery fees.
The Consumer is advised to check their order status regularly and contact SELKEYS FRANCE at contact@selkeys.fr for any questions or delivery issues.
Products are delivered to the address provided by the Consumer during the ordering process. The Consumer must ensure their address is accurate and includes details such as a visible name on the mailbox, building access codes, or a phone number to facilitate delivery. SELKEYS FRANCE cannot be held liable for failed deliveries resulting from incomplete or incorrect address information provided by the Consumer.
If the Consumer is unavailable during delivery, the parcel may be left at the nearest postal office. In such cases, it is the Consumer's responsibility to retrieve the parcel within the allotted timeframe. If the parcel is returned to SELKEYS FRANCE, the Consumer may incur additional return costs.
Upon receipt of the parcel, the Consumer is advised to inspect its condition and contents. If the parcel appears damaged (e.g., opened or leaking), the Consumer should refuse delivery and request that it be returned to SELKEYS FRANCE.
Article 12. Written Proof and Information
The Consumer acknowledges that any personal information provided, including login credentials or billing details, serves as proof of identity and agreement to the operations performed on the Website.
The Consumer is solely responsible for maintaining the confidentiality of their login credentials and for notifying SELKEYS FRANCE immediately in case of suspected fraud or unauthorized use.
SELKEYS FRANCE reserves the right to terminate accounts or restrict access to services in cases of misuse, unauthorized sharing, or fraudulent behavior.
Article 13. Privacy Policy
SELKEYS FRANCE is committed to protecting your privacy and maintaining the confidentiality of your personal data. The privacy policy outlines how data is collected, used, shared, and secured.
Article 14. Website Operation
The Website is typically accessible 24/7, except in cases of force majeure, maintenance, updates, or technical upgrades. SELKEYS FRANCE is not liable for interruptions due to external factors such as network issues or unsuitable consumer equipment.
Article 15. Consumer Reviews
By submitting a review on the Website, the Consumer grants SELKEYS FRANCE a free, worldwide, and 10-year license to reproduce and use their review and pseudonym across various platforms, including e-shops and social media.
Article 16. Intellectual Property
All intellectual property rights related to the Website and its content are owned by SELKEYS FRANCE. Any unauthorized reproduction, distribution, or use of the Website’s content is strictly prohibited and may result in legal action.
Article 17. Hyperlinks
Links to third-party websites are provided for informational purposes. SELKEYS FRANCE is not responsible for the content, services, or products available on such sites.
Article 18. Force Majeure
SELKEYS FRANCE cannot be held liable for delays or failures resulting from events beyond its control, including strikes, natural disasters, or technical malfunctions.
Article 19. Termination of Subscriptions
Consumers may cancel subscriptions at any time through their account settings or by contacting Customer Service.
